("Desky", "we", "us" or "our") operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Our store is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us, and the rights you have in relation to it.

1. Who Is Responsible for Your Personal Information

2. Personal Information We Collect or Process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services and as permitted or required by applicable law:

  • Contact details including your name, address, billing address, shipping address, phone number, and email address.
  • Payment information including transaction details, form of payment, payment confirmation and other payment details. Card and bank details are entered directly with our payment providers; we do not see or store your full card number.
  • Account information including your email address, login details, preferences and settings.
  • Transaction information including the items you view, put in your cart, or purchase, return, exchange or cancel and your past transactions.
  • Delivery information including delivery instructions, access details and delivery date preferences, which our freight carriers need to deliver bulky items.
  • Warranty and product information including product serial numbers and photos or videos you send us of a fault or damage.
  • Business information if you buy as a business, including your company name and VAT number.
  • Communications with us including the information you include in communications with us, for example, when sending a customer support enquiry.
  • Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
  • Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

3. Personal Information Sources

We may collect personal information from the following sources:

  • Directly from you including when you create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information;
  • Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;
  • From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;
  • From third parties such as payment providers (for example, whether a payment was approved), carriers (delivery status) and social media platforms if you interact with us there.

4. How We Use Your Personal Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes. For each purpose we state the legal basis under the General Data Protection Regulation (GDPR):

4.1 Provide, Tailor, and Improve the Services.
We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfil your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a personalised shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services. Legal basis: performance of our contract with you (Art. 6(1)(b) GDPR) and, for tailoring and improving the Services, our legitimate interest in offering a relevant, well-functioning store (Art. 6(1)(f) GDPR). Where this uses cookies or similar technologies on your device, we do so only with your consent (section 10).

4.2 Delivery.
We share your name, delivery address, phone number and email address with our warehouse and carriers so they can book and complete your delivery. Bulky items such as desks cannot be delivered without a contact phone number. Legal basis: performance of our contract (Art. 6(1)(b) GDPR).

4.3 Returns, Warranty and Product Safety.
We use your order and contact details to handle withdrawals, returns and warranty claims, and to contact you if a product you bought is subject to a safety notice or recall. Legal basis: performance of our contract (Art. 6(1)(b) GDPR) and compliance with our legal obligations, including under the EU General Product Safety Regulation (Art. 6(1)(c) GDPR).

4.4 Marketing and Advertising.
We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services, which involves building a profile of your interests. Specifically:

  • Newsletter. If you sign up on our website or tick the marketing box at checkout, we send you marketing emails based on your consent (Art. 6(1)(a) GDPR). We ask you to confirm your sign-up by clicking a link in an email. If you consent, we also measure whether you open and click our emails, to improve them.
  • Existing customers. If you buy from us and do not tick the marketing box, we may still email you about our own products and services similar to those you bought, unless you object. You can object when you give us your email address at checkout and in every email we send, at no cost other than your usual transmission costs. We do not track whether you open or click these emails. We treat requests to review a purchase in the same way. Legal basis: our legitimate interest in direct marketing to our customers (Art. 6(1)(f) GDPR), within the national rules on electronic marketing to existing customers. This does not apply to customers in Poland: we send marketing emails to customers in Poland only with their consent.
  • Text messages. We send marketing text messages only if you have given your prior consent (Art. 6(1)(a) GDPR). You can withdraw it at any time by replying STOP or contacting us.
  • Postal mail. We may send you offers by post based on our legitimate interest in direct marketing (Art. 6(1)(f) GDPR). You can object at any time.
  • Online advertising. We use cookies, pixels and similar technologies for personalised advertising and to measure our campaigns only with your consent (Art. 6(1)(a) GDPR). See sections 10 and 11.

4.5 Security and Fraud Prevention.
We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else. Legal basis: our legitimate interest in protecting our store, our customers and payments against fraud and misuse (Art. 6(1)(f) GDPR). When you visit the store, Shopify's servers automatically record technical access data (such as your IP address, date and time, pages requested and browser) to deliver the store and keep it secure. Legal basis: our legitimate interest in a secure, working website (Art. 6(1)(f) GDPR).

4.6 Communicating with You.
We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you. Legal basis: performance of our contract where your request relates to an order (Art. 6(1)(b) GDPR), and otherwise our legitimate interest in answering you (Art. 6(1)(f) GDPR). Where our chat or customer support uses an automated assistant, we tell you when you are talking to one, and you can ask for a person at any time. We record phone calls only if you agree at the start of the call, to check the quality of our support, train our team and keep a record of what was agreed. If you do not agree, the call is not recorded. Legal basis: your consent (Art. 6(1)(a) GDPR).

4.7 Legal Reasons.
We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to keep accounting and tax records, to investigate or participate in potential or actual legal proceedings, and to enforce or investigate potential violations of our terms or policies. Legal basis: compliance with our legal obligations (Art. 6(1)(c) GDPR) and our legitimate interest in establishing, exercising or defending legal claims (Art. 6(1)(f) GDPR).

5. Do You Have to Give Us Your Information?

Information marked as required at checkout or in a form is needed to enter into and perform our contract with you, or to answer your request. If you do not provide it, we cannot take or deliver your order. Everything else is optional.

6. Automated Decisions

We do not make decisions that produce legal effects concerning you, or similarly significantly affect you, based solely on automated processing. Orders flagged by our fraud checks are reviewed by a person. If you choose to pay with Klarna, Klarna carries out an identity and credit check and decides whether to offer that payment method, under its own privacy notice.

7. How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping). They act on our instructions under data processing agreements. Our main service providers are: Shopify International Limited (store platform and payments); +Fulfilio Sp. z o.o., Warsaw, Poland (warehousing, fulfilment and returns); Quidkey (Bnqz, Inc., USA) (pay-by-bank payments, for the data it handles on our behalf); Klaviyo and Shopify Email (email marketing); Okendo (product reviews); Trustpilot (review invitations); Zendesk (customer support tickets); Aircall SAS, France (phone system and call recordings); CCIG Group Sp. z o.o., Wrocław, Poland (customer contact centre, working in our systems); and Cin7 (inventory and order management).
  • With business and marketing partners to provide marketing services and advertise to you. Our business and marketing partners will use your information in accordance with their own privacy notices. We only share information with these partners for personalised advertising with your consent, which you can withdraw at any time through Cookie settings.
  • With payment providers that act as independent controllers and process your information under their own privacy notices: Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden; PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg; and, if you pay by bank transfer through Quidkey, Bnqz, Inc., 480 NE 31st Street, Miami, FL 33137, USA. Quidkey uses your payment information to process the payment, prevent fraud, meet its legal obligations and recognise you when you pay at other merchants that use Quidkey.
  • With Trustpilot, if you write a review on Trustpilot. Trustpilot processes your review and reviewer account as an independent controller under its own privacy notice.
  • With the carrier that delivers your order, which depending on your address and order may be DHL, GLS, FedEx, DPD, UPS or InPost. Carriers use your delivery details to deliver your order and contact you about it, as independent controllers under their own privacy notices.
  • With our professional advisers (such as accountants, auditors and lawyers) and with public authorities, including tax authorities, where the law requires it.
  • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group, including Desky Pty Ltd in Australia, which provides customer support, operations and marketing services to us. See section 16.
  • In connection with a business transaction such as a merger or insolvency, to comply with any applicable legal obligations (including to respond to lawful requests from courts and public authorities), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

8. Relationship with Shopify

The Services are hosted by Shopify (Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland), which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy. You can exercise your rights in relation to that processing through the Shopify Privacy Portal (privacy.shopify.com).

9. Third Party Websites and Links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

10. Cookies and Similar Technologies

We use cookies and similar technologies that are strictly necessary to run the store. We use all others only with your consent (Art. 6(1)(a) GDPR), which you give or refuse in our cookie banner by category. You can change or withdraw your consent at any time through the Cookie settings link at the bottom of every page. Refusing does not affect your ability to shop with us.

Google services are provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Shopify lists its cookies and their durations at shopify.com/legal/cookies. For other providers, see their privacy notices.

11. Social Media and Advertising Platforms

We have pages on Facebook and Instagram and advertise through Meta and TikTok. For page statistics, and for collecting and sending data through their pixels and server-side events, we are joint controllers with Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland, and TikTok Technology Limited, 10 Earlsfort Terrace, Dublin 2, Ireland. We use these tools only with your consent. Each platform is responsible for its own later processing, described in its privacy policy. You can exercise your rights with us or with the platform. We also run global Desky pages on LinkedIn, YouTube and Pinterest. If you visit them, the platform processes your information under its own privacy policy. For LinkedIn page statistics, we are joint controllers with LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland.

12. Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

13. Security and Retention of Your Information

We use appropriate technical and organisational measures to protect your personal information, including encrypted connections, access controls and contracts with our service providers. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. In particular:

When a retention period ends, we delete or anonymise the information.

14. Your Rights

You have the following rights in relation to your personal information. Some of them apply only in certain circumstances, and in some cases we may decline a request as permitted by law.

14.1 Right of Access.
You have the right to request access to, and a copy of, personal information that we hold about you.

14.2 Right to Delete.
You have the right to request that we delete personal information we maintain about you.

14.3 Right to Correct.
You have the right to request that we correct inaccurate or incomplete personal information we maintain about you.

14.4 Right of Portability.
You have the right to receive a copy of the personal information you have provided to us, in a structured, commonly used and machine-readable format, and to request that we transfer it to another controller, in certain circumstances and with certain exceptions.

14.5 Managing Communication Preferences.
We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you or by contacting us. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

14.6 Restriction of Processing.
You have the right to ask us to restrict our processing of personal information in certain circumstances, for example while we check a correction you have asked for.

14.7 Withdrawal of Consent.
Where we rely on consent to process your personal information, you have the right to withdraw this consent at any time. If you withdraw your consent, this will not affect the lawfulness of any processing based on your consent before its withdrawal.

14.8 Instructions After Death (France).
If you live in France, you may also give us instructions about how your personal information is to be handled after your death.

14.9 Your Right to Object

Where we process your personal information on the basis of our legitimate interests, you have the right to object at any time on grounds relating to your particular situation. Where we process your personal information for direct marketing, including profiling for that purpose, you may object at any time without giving a reason, and we will stop.

You may exercise any of these rights where indicated on the Services or by contacting us using the contact details provided below. Exercising your rights is free of charge, unless a request is manifestly unfounded or excessive. You can also ask us for more information about how we balanced our legitimate interests against yours. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. We will respond within one month of receiving your request. We may extend this by up to two further months for complex or numerous requests, in which case we will tell you within the first month. If we do not act on your request, we will tell you why, and you may complain to a supervisory authority.

15. Complaints

If you have complaints about how we process your personal information, please contact us using the contact details provided below. You also have the right to lodge a complaint with a data protection supervisory authority. Our lead supervisory authority is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warsaw, Poland (uodo.gov.pl). You may also complain to the supervisory authority in the EU country where you live or work. You can find a list of all EEA supervisory authorities here.

16. International Transfers

Please note that we may transfer, store and process your personal information outside the country you live in.

Some of our service providers, and our group company Desky Pty Ltd, are located outside the European Economic Area (EEA). Where we transfer your personal information outside the EEA, we rely on either an adequacy decision of the European Commission (for example, for Canada, and for United States companies certified under the EU-US Data Privacy Framework) or the European Commission's Standard Contractual Clauses (for example, for transfers to Australia, including to Desky Pty Ltd and Okendo, and to United States providers that are not certified). You can request a copy of the relevant safeguards by contacting us.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website and update the "Last updated" date. If we make material changes, we will tell you by email or by a notice on the Services before they take effect.
